Is There a Deadline to File a Claim with the 9/11 Victim Compensation Fund?

Is there a deadline to file a claim for the 9/11 Victim Compensation Fund (VCF)? Yes. All claims must be fully submitted to the VCF prior to December 18, 2020 – but you should consider filing sooner. The $7 billion fund dedicated to providing financial compensation is running dangerously low.

In fact, Rupa Bhattacharyya, Special Master for the VCF, recently warned that the amount of remaining money might not be enough to cover all filed claims.

Who Qualifies?

Those who may qualify include 9/11 first responders (at Ground Zero, The Pentagon, and Shanksville, Pennsylvania), workers, students, and residents of Lower Manhattan, Pentagon workers, and other 9/11 survivors.

The Facts

Over 60,000 people taking part in the World Trade Center (WTC) Health Program have at least one covered illness, and a large percentage of this group have multiple covered illnesses which can be directly attributed to the events of 9/11 and its aftermath. Additionally, over 9,000 people have been diagnosed with 9/11-related cancers.

File Before February 1, 2019

Claims filed AFTER February 1, 2019, may see significant reductions in the amount of compensation awarded for certain illnesses, including 9/11-related cancers. That’s why the experienced attorneys at Turley Hansen & Rosasco, LLP strongly encourages all eligible individuals to file a claim prior to February 1, 2019, if possible.

Why Hire an Attorney?

Filing a claim with the VCF can be cumbersome. While it is not required to hire a lawyer in order to file, over 80-percent of claimants choose to do so in order to receive help with the following:

  • Enrolling in the WTC Health Program in order to obtain the required certification of a 9/11-related illness
  • Obtaining the necessary eyewitness affidavits to prove they were in the crash site area
  • Filing all of the necessary paperwork
  • Writing legal briefs so they can receive the maximum compensation possible
  • Appealing any eligibility denials and attending formal legal hearings (if necessary)
